The Labour Government's draft Employment Rights Bill is set to introduce ‘once in a generation’ reforms to workers’ rights.
Labour’s once in a generation employment reforms Bill has arrived. But what will it mean for employers and employees? Will it actually make positive change? How will it protect workers rights whilst not obstructing an employer’s drive for productivity.

Over the coming weeks, we will be unpacking the changes that the Bill will bring and their implications for employers, culminating in a webinar with our experts on Thursday 28 November.
What will be the areas of focus for the webinar?
The Bill is expected to go through several rounds of consultation and negotiations with unions and business groups. But the big topics up for discussion will likely focus on the themes of:
• Statutory sick pay (SSP): Changes to the duration of an illness before SSP can be claimed.
• Lower earnings limit for SSP: The £123 limit of SSP is set to change, with a new lower limit introduced.
• Paternity leave: Changes to the 26 week period of employment before Fathers are eligible for Paternity leave.
• Unpaid parental leave: Eligibility to begin from day one.
• Unpaid bereavement leave: Also set to become a ‘day one’ right.
• Flexible working: Bosses will have to assess flexible working requests from day one of employment with greater restrictions on employers declining the requests.
What we know so far.
There are some significant changes planned. There is a lot to address, which we will cover in our webinar. so the headlines are: employment rights reforms, including changes to zero-hour contracts, flexible working requests, third party harassment, day one rights: yes this includes the right to claim unfair dismissal, albeit following an ‘initial period of employment’. Whilst commentary has suggested nine months, the legislation does not set a defined time frame. Other reforms include changes to statutory sick pay, parental, bereavement, and paternity leave.
Other matters relating to employment such as redundancy collective consultation applying across a business and not just at one establishment. Pay and conditions in certain sectors including school support staff and adult social care. There is a lot regarding trade unions and there will be enforcement of labour market legislation (i.e. the Fair Work Agency previously referenced allowing for quicker resolution of breaches under set legislation identified in the Bill).
The press addressed the Government’s ‘Next Steps’ which are other proposed reforms which are not addressed in this bill, such as the right to switch off and a single status rather than employee and worker.
