Claim wins £115,000 more than the original offer

A 53 year old lady suffered a concussive head injury, severe fractures to her lower limbs, and psychological damage when she was run down by a motorist while using a zebra crossing.

A 53 year old lady suffered a concussive head injury, severe fractures to her lower limbs, and psychological damage when she was run down by a motorist while using a zebra crossing. Mrs X instructed Ian Carrier, Partner in RWK Goodman’s Oxford offices to handle her personal injury claim.

Following the accident Mrs X was unable to return to paid employment due to a combination of her physical injuries (initially) and her psychological injuries (latterly). The fact that Mrs X didn’t return to work caused the defendant to argue that Mrs X had failed to keep her financial losses to a minimum by not seeking alternative work. Ian argued that because of the accident, Mrs X was not fit for any work, inactive or otherwise. Ian obtained key expert evidence in respect of Mrs X’s care needs, aids/equipment and help with domestic tasks.

Subsequent offers increased in the 3 weeks leading up to trial. Ian finally settled the case for £175,000 6 days before the start.
