Six-figure settlement secured for widow of former electrician.

Mr M was a fit and active 69-year-old prior to his diagnosis of mesothelioma.

During the late 1960s and early 1970s, Mr M worked as an apprentice engineer for Lund Roberts (Engineers) Limited. His role involved cutting insulation boards, fireproofing void spaces, and handling electrical wiring. These tasks regularly exposed him to asbestos dust and fibres; alongside asbestos dust which was released into the air by laggers mixing asbestos powder and handling crumbling lagging.

Our investigations began with researching Lund Roberts (Engineers) Limited who had passed a resolution to voluntarily wind-up their company. We liaised with the liquidator of the company and traced the insurers who had provided employer’s liability cover at the time of Mr M’s employment.

We issued court proceedings after gathering witness evidence and researching the asbestos products Mr M had been exposed to. The Defendant attempted to dispute the claim, arguing that the insurance did not cover the period in question. However, following disclosure from HMRC which clearly showed Mr M was employed at the relevant period, the Defendant accepted employment, admitted liability, and consented to judgment being entered against them.

Tragically, Mr M passed away, and his widow continued the claim on his behalf. We worked to gather evidence on quantum, including details of Mr M’s successful business, which he had retired from after his diagnosis. The case was resolved with a substantial six-figure settlement, accounting for loss of earnings, financial dependency, and dependency on services. Mr M had been a pillar of his household, and his legacy lives on through the justice secured for his family.
